  • Familiarizing with and accepting these regulations is a condition of using the Online Store.

  • II. GLOSSARY OF TERMS:
  •  
  • Online Store - a shop operating at http://www.mamastory.pl, selling products in its offer via the Internet;
  • Product page - a page in the Online Store where information about the product is provided;
  • Client - a natural or legal person making purchases in the Online Store;
  • Shopping Cart - an element of the Online Store, by means of which the Customer specifies the details of the order such as: number of products, delivery address, invoice data, delivery method, payment method, etc. By placing an order, the Customer may enter in the Cart the rebate code number entitling him to a discount ( depending on the type of code);
  • Delivery time - the time at which the Online Store will complete the order and will forward it to the warehouse by mail or courier, to the address indicated by the Customer;
  • Warehouse - a place where customer orders are completed;
  • Working days - all days of the week from Monday to Friday, excluding statutory holidays;
  • Online Store Database - a database containing data on transactions and goods that are offered in the Online Store. The database also stores data about customers using the Online Store to fulfill orders placed by them;
  • Entity realizing the payment - an intermediary in relation to the Online Store an intermediary when making payment by means of an electronic transfer, bank transfer or credit card payment
  • Newsletter - an e-journal (periodical) published periodically by the Online Shop, in which are published, among others information about the Mamastory.pl Online Shop offer and information about promotions and competitions.

§ 1

 

  • Conditions of order fulfillment

  • The customer may place orders for 24 (in words: twenty four) hours a day via the website http://www.mamastory.pl. The customer places the order, indicating the product he is interested in, using the "ADD TO THE CART" or "TO CART" option, and then in the Basket indicates the method of receipt of the product and payment for the order.
  • It is also possible for the Customer to place orders via e-mail addressed to the address kontakt@mamastory.pl, which must contain all the elements indicated in §1 para. 5 of the Regulations of the Online Store. The customer's message starts the ordering procedure. The final submission of the contract and conclusion of the contract occurs after the customer sends an e-mail with a clear confirmation of the will to conclude the contract, after the customer has read the information sent by the Online Shop.
  • By placing an order, the Customer concludes a sales contract for the ordered goods with the Online Store.
  • In the case of contracts concluded with a consumer within the meaning of art. 221 of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2016, item 380, as amended), the place of performance is the place where the Online Store is obliged to send the order. In the case of personal collection, the place of performance is the Mamastory office (Zwycięzców 40 / 169.03-938 Warsaw)
  • In the order (in the Cart / e-mails), the Customer specifies:
  • At the stage of placing the order, the customer can enter the code received from the Online Store entitling him to a discount.
  • At the time of ordering, the customer may be able to divide the order into several packages. In this situation, the Online Shop may divide the order taking into account the expected time of order completion. The customer is informed about the costs of the ordered goods and the delivery costs.
  • The Online Store is not liable for non-delivery of goods or delay in delivery of ordered goods or order fulfillment, resulting from incorrectly given by the customer or inaccurate delivery address.
  • The delivery of the ordered goods will be made only when the ordered goods are in stock. If the Product or products covered by the Customer's order are out of stock and ordering them from suppliers is not possible within the time allowed for the order to be processed or the goods can not be delivered on the Customer's order, the Store will send a message to the Customer via e-mail provided by Customer, with a request to make a decision regarding further proceedings regarding the contract and will propose a new deadline for the contract. In this situation, the Customer may resign from the fulfillment of the order in a part that can not be executed within 3 days from the date of informing him about the need to extend the contract. Online Store, on Customer's request, will extend the time of order completion.
  • Irrespective of the rights described above, in the absence of goods in the Store or the inability to fulfill the Customer's order, the Online Store has the right to withdraw from the contract within 30 (thirty) days from the date of its conclusion. If the expected date of the contract is longer than 30 (thirty) days, the Online Store has the right to withdraw from the contract within the time allowed for the execution of the order. If the payment for the goods has taken place in advance, the Online Store will immediately refund the amount due for the goods to the Customer in the same way as the payment took place.

  • Prices of goods

  • The Online Store places information about its offer on the website http://www.mamastory.pl and offers the goods located in the Online Store database.
  • Prices in the Online Store placed on the offered product:
  • The binding and final price is the price of the product given on the Online Store at the time of placing the order by the Customer using the button "Place an order with the obligation to pay" or at the confirmation of the Customer's intention to place an order via e-mail.
  • Information on the total value of the order is presented on the Online Store website after the Customer selects the form of delivery and payment method.
  • In the case of orders submitted via e-mail, the Customer is informed about the total value of the order in the return message from the Online Store.
  • The Online Shop reserves the right to make changes to the prices of goods on offer on an ongoing basis and to carry out and cancel all types of promotional campaigns and sales. The authorization referred to in the preceding sentence does not affect orders placed before the effective date of the price change, the conditions of promotional campaigns or sales, which will be implemented on the current basis.
  • Promotions in the Online Store are not subject to merging, unless the regulations of a given promotion state otherwise. The Online Store is not responsible for the mistaken combination of two or more promotions as a result of an IT system error and is entitled to cancel such an order.

  • they do not contain information on possible customs duties.

  • Order modification

  • Changes in the order can be made by contacting the Online Store via email to the address kontakt@mamastory.pl, provided that the order has not been completed and sent to the delivery address indicated by the Customer.
  • The changes may concern: resignation from the entire order or its part, as well as changes in the delivery address, method of delivery, or changes to the invoice data. In the event of cancellation of the order, if the payment for the goods has been made in advance, the refund will be made within 14 (fourteen) days from the date of receipt of the customer's resignation to the Customer's bank account from which the payment was made. If the Customer does not have a bank account, the amount will be returned by postal order to the address indicated by the Customer.
  • The right to resign from the order is not valid for orders that include items manufactured according to the customer's specification or to satisfy his individual needs, if the order execution process has been started.

  • Payment methods and starting the order

  • 1. Payments for goods to be delivered in Poland can be made:
  •  
  • by bank transfer, bank transfer or credit card - the order will be processed after the Online Store has received confirmation by the Entity that makes the payment of the correct payment.
  • The customer may use the rebate code received from the Online Store.
  • Rebate codes are valid for the period of validity during which the Customer can take advantage of the rebate offered. The rebate code can not be combined with any other rebate code or other promotions, unless the terms of the promotion indicate otherwise.
  • In the case of selected products or product categories, the Online Store reserves the right to exclude certain delivery methods or forms of payment for the order.

  • Delivery time. Supply.
  •  
  • With the products offered, the Online Store indicates the time of order fulfillment (in working days). The order delivery time is given taking into consideration the date of completion of all ordered goods.
  • An order in Poland may be delivered via a courier company to the delivery address indicated by the Customer.
  • Delivery costs do not include assembly of individual elements of the contract.
  • The customer is obliged to collect the ordered goods. In the case of personal collection, the Customer is obliged to collect the order within 7 days from the date of notification by the Store about the possibility of receiving the order. If the Customer does not collect the goods delivered by the courier or the expiry of the deadline for personal collection of the goods, the Shop will call the Customer to collect the goods within 14 days. After the expiry of the deadline, the Store will alternatively be entitled to:
  • withdraw from the contract,
  • selling the goods at the customer's expense,
  • returning goods not collected by the Customer for storage - at the cost and risk of the Customer,
  • charging for non-contractual storage of the order, which will amount to PLN 5 gross per one item of uncollected goods charged for each day of storage. The Store will notify the Customer immediately about the decision regarding further processing of the unaccepted goods. Using the Store with one of the above-mentioned rights does not exclude the possibility of the Shop seeking compensation for non-performance or improper performance of the contract by the Customer.

  • Complaint

  • The Online Store provides products without defects.
  • In the event that the sold item has a physical or legal defect, the Customer has the right to claim warranty rights in accordance with the provisions of the Civil Code.
  • The Customer should inform the Online Store of any intention to assert his rights with the warranty by e-mail or telephone. The Online Store will collect from the Customer the advertised goods along with proof of purchase and completed Complaint Form, posted on the website http://www.mamastory.pl, at their own expense. It is also possible for the customer to deliver goods along with proof of purchase and complaint form to the following address: Mamastory s.c, ul. Winners 40/169, 03-938 Warsaw.
  • The online store within 14 (fourteen) days from the date of receipt of the advertised goods together with the necessary documentation will address the customer's application and notify him of the way of proceeding.
  • In the event of a defect in the advertised product, the Online Store will consider the complaint in favor of the Customer. The Online Store will immediately repair or replace the advertised product with a fully-fledged one if it does not cause excessive inconvenience to the Customer.
  • The customer is obliged to collect the goods for which claims were made with a warranty. If the Customer fails to collect the goods, the Store will call the Customer to collect the goods within 14 days. After the expiry of the deadline, the Store will be entitled to charge for the non-contractual storage of goods, which will amount to PLN 5 gross per one item of uncollected goods charged for each day of storage. The Store shall immediately notify the Customer of the decision regarding further handling of the uncollected good.
  • The Online Store is liable under the warranty if the defect is reported within 2 (two) years from the date of delivery of the goods to the Customer, if within one year after the detection of the defect, the Customer will notify the Online Store.
  • In the case of contracts concluded with customers who are not consumers within the meaning of art. 221 of the Civil Code, the Online Shop excludes its liability under the warranty.
  • § 7

  • The right to withdraw from the contract
  •  
  • In accordance with the applicable provisions of the Act on consumer rights (Journal of Laws of 2014, item 827), the customer has the right to withdraw from the contract without giving a reason within 14 days of taking possession of the subject of the contract or from the date on which the person a third party other than the carrier and indicated by the Customer came into possession of the subject of the order, and if the Contract of Sale includes many products that are delivered separately, in batches or in parts - from taking possession of the last product, lot or part.
  • The possibility to exercise the right to withdraw from the contract depends on the Customer's unambiguous declaration of withdrawal from the contract within the time specified in §7 para. 1. To meet the deadline, it is enough to send a statement before its expiry.
  • In the event of withdrawal from the contract, it is considered void.
  • The declaration on withdrawal from the contract should contain information allowing to specify the contract to which it relates. It may be submitted on the withdrawal form, the model of which is attached as Appendix 1 to these Regulations. The statement should be sent by e-mail to the address kontakt@mamastory.pl. The Online Shop is obliged to send an e-mail confirmation of receipt of a statement of withdrawal from the contract.
  • The Online Store is obliged within 14 days of receiving a statement of withdrawal from the contract, return the payment made by the Customer, including the cost of delivering the item, while the Online Store is responsible for the cost of delivering items to the cheapest way of delivery. At the same time, the Online Store reserves the right to withhold reimbursement of received payments until the receipt of the subject of the order back or delivery by the Customer of proof of its return.
  • The customer is obliged to return the subject of the order within 14 (fourteen) days from the date of submitting the statement of withdrawal from the contract. Returned goods must be delivered to the address Mamastory s.c., ul. Zwycięzców 40 / 169.03-938 Warsaw. All returns to the warehouse must be preceded by an agreed date of receipt of the goods.
  • The customer bears the direct costs of returning the subject of the order.
  • The customer is obliged to return along with all documents, carriers and instructions he has received and bears responsibility for reducing the value of the item as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the subject of the order.
  • The Online Shop will accept refund when the goods are delivered by the Customer to the address given in § 7 para. 5. The Online Store does not accept parcels sent for downloading.
  • All refunds of the price paid for the returned goods shall be effected by paying the nominal amount expressed in Polish zlotys. If the payment of the order has been made from a bank account kept in a foreign currency, the refund will be made to the indicated bank account in Polish zlotys and then converted into the currency in which the given bank account is converted according to the average exchange rate of the National Bank of Poland recognition.
  • The right to withdraw from the contract is not applicable to orders for items manufactured according to the customer's specification or to satisfy his individual needs, in particular window decorations and personalized products.
  • In the case of customers who are not consumers within the meaning of art. 221 of the Civil Code, the provisions of § 7 of the Regulations shall not apply.

  • Mamastory Newsletter
  •  
  • The customer can subscribe to the Mamastory Newsletter.
  • The use of the Mamastory Newsletter service is voluntary and indefinite.
  • In order to provide the service from interested persons, the names of e-mail addresses are obtained.
  • The newsletter is sent only to people who have expressed a desire to receive it.
  • By subscribing to the Newsletter, the Customer agrees to receive commercial information from the Online Store via email, as well as consent to the processing of personal data in the necessary for this purpose.
  • To receive the Mamastory Newsletter, fill out the electronic form correctly:
  • The customer may, at any time, change or remove his data entered in the registration process.
  • In order to change the e-mail address to which the Mamastory Newsletter should be sent, a new e-mail address should be sent to kontakt@mamastory.pl.
  • In order to delete an e-mail account from the subscriber base of the Newsletter, click the button named "Click to unsubscribe from the Mamastory Newsletter. This action will remove the address from the list of subscribers and will stop sending subsequent editions of the Newsletter.
  • The data administrator is Mamastory s.c., based in Warsaw (03-938) at ul. Winners 40/169, according to § 10 para. 1 of these Regulations.

  • enter the e-mail address to which the Newsletter should be sent. The e-mail address entered must belong to or be at the disposal of the person registering. It is not allowed to use e-mail addresses that do not belong to the persons who register.

Expressing consent to the processing of personal data should be confirmed by clicking on the check box next to the accepted content and entering the acceptance mark in it (ie the symbol)

  • The administrator of personal data is Mamastory s.c., with its registered office in Warsaw (03-938) at ul. Winners 40/169. Personal data (ie name, e-mail address) are collected in order to answer the question in the contact form and for the implementation of the Mamastory newsletter service. The data will not be made available to recipients of data within the meaning of art. 7 point 6 of the Act on the Protection of Personal Data. The data subject has the right to access their data and the possibility of correcting them. The data is given by the persons they refer to voluntarily, but without them it is not possible to implement the above-mentioned data. services.
  • Personal data are processed and secured in accordance with the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 2016, item 922), and in particular against unauthorized disclosure, removal by an unauthorized person, processing in violation act and change, loss, damage or destruction.
  • By placing an order in the Online Store, the Customer agrees to the processing of his personal data related to the execution of orders made in the Online Store. The lack of consent to the processing of personal data makes it impossible to complete the Customer's order by the Online Store. The customer is liable for providing false personal data.

  • Final Provisions

  • The goods presented on the Online Store website do not constitute an offer in accordance with the Civil Code.
  • The Online Store is not responsible for blocking by the administrators of e-mail servers the possibility of sending messages to the e-mail address indicated by the Customer and for deleting and blocking e-mails by software installed on the computer used by the Customer.
  • The online store makes every effort to ensure that the photos of the goods and their description correspond to reality as accurately as possible. Due to the possibility of errors during the upgrade (eg prices, configurations, etc.) - any discrepancies will be corrected during the execution of the order.
  • The prices listed in the Online Store are valid only in the Internet offer.
  • In matters not covered by the Regulations, the provisions of Polish law, in particular the Civil Code and the provisions of the Act on consumer rights shall apply.
  • All names of goods offered for sale by the Online Shop are used for identification purposes and may be protected and reserved under the provisions of the Industrial Property Law Act (Journal of Laws of 2013, item 1410, as amended).
  • These Regulations are effective from February 1, 2017.
  • Online Store www.mamstory.pl reserves the right to change the Regulations.
  • Any changes to the Regulations are effective from the date they are published on the website http://www.mamastory.pl. Orders placed before the date of introduction of the Regulations or amendments to the Regulations will be implemented on the basis of the rules in force on the date of placing the order.
